The Allahabad High Court, while rejecting the anticipatory bail application of a teacher working in a primary school for 11 years on the basis of a fake mark sheet, refused to grant anticipatory bail, saying that the gangs making fake mark sheets are crippling the social structure and destroying the education system. The teacher is accused that he was appointed from Agra University on the basis of a fake mark sheet of B.Ed and was teaching since 2009. A case has been registered against him under sections 420, 467, 468, 471 of the Indian Penal Code at the police station- Ahmedgarh, Bulandshahr for fake mark sheets.

In this case, the petitioner had filed a petition in the High Court seeking anticipatory bail. The counsel for the petitioner said that he had no fault in getting this mark sheet. He did not know that his mark sheet was fake, while opposing the anticipatory bail application, Additional Advocate General Vinod Kant said that the racket of making and giving fake mark sheets through middlemen was going on in UP. The petitioner has been taking advantage of fake mark sheets for many years. He cannot say that he was not aware of the fake mark sheet.

Rejecting the anticipatory bail application of petitioner teacher Sunil Kumar, Justice Vivek Agarwal said that the petitioner should surrender himself in the court and cooperate in the investigation. The court said that there is a long chain of middlemen, masterminds, and beneficiaries in the gang making fake mark sheets. The investigation is necessary to get to its roots. In such cases, custody sometimes becomes necessary for investigation.
